CA affirms GMA Network’s libel case Vs ABS-CBN

The Court of Appeals (CA) has granted the petition filed by GMA Network to file libel against retired ABS-CBN chairman and CEO Eugenio Lopez III and several other current and former ABS-CBN employees.

This because of the statements conveyed that GMA Network as thieves of footages shot by ABS-CBN. GMA Network filed the civil case against ABS-CBN after it accused the latter of stealing a video footage of the arrival of Iraqi hostage victim Angelo de la Cruz in 2004.

Under the Revised Penal Code, libel is committed when there is defamatory imputation that causes dishonor, publicity of the libelous matter, the identification of the defamed person or entity, and malice on the part of the accused.

Aside from Lopez, those covered by libel were:

• Jose Ramon Olives, officer-in-charge or senior vice-president;
• Jake Maderazo, vice-president news operations;
• Luisita “Luchi’’ Cruz-Valdes, former vice-president news productions/program;
• Jose “Jing” Magsaysay Jr., assistant vice president news operations;
• Alfonso “Pal” Marquez, director news operations of ABS-CBN.
• Lynda Jumilla, reporter;
• Maria Progena Estonilo Reyes, supervising producer;
• Annie Eugenio, executive producer  of Magandang Umaga Bayan; Dondi Garcia, who was executive producer of News Patrol.
